1. Acceptance of Terms
By downloading, accessing, or using Aegis ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. These Terms apply to all users of the App, including law enforcement personnel, trainees, and any others who access Aegis.
2. Description of Service
Aegis is a law enforcement reference application designed for Georgia peace officers. The App provides access to O.C.G.A. (Official Code of Georgia Annotated) codes, case law references, field tools, note-taking capabilities, and related resources intended to assist officers in the field. Aegis is a supplemental reference tool and does not replace official training, legal counsel, or department policies.
3. Eligibility and Use
To use Aegis, you must meet the following requirements:
Age Requirement: You must be at least 18 years of age.
Intended Users: Aegis is designed for law enforcement professionals, criminal justice students, legal professionals, and individuals with legitimate professional interest in Georgia law.
Account Security: You are responsible for maintaining the confidentiality of any account information and for all activities occurring under your account.
Lawful Use: You agree to use Aegis only for lawful purposes and in accordance with your department's policies and applicable laws.
4. Disclaimer of Legal Advice
IMPORTANT: The information provided in Aegis, including but not limited to O.C.G.A. codes, case law summaries, Miranda warnings, DUI procedures, search protocols, and field tools, is for general reference purposes only and does not constitute legal advice.
The App is not a substitute for consultation with qualified legal counsel or official department training.
Laws, statutes, and case law are subject to change, amendment, and judicial interpretation.
You are solely responsible for verifying the accuracy and applicability of any information before relying upon it in the field or in legal proceedings.
ASH Labs does not guarantee that the information in Aegis is complete, current, or error-free.
5. User Content and Field Notes
Aegis allows you to create and locally store field notes on your device, including traffic stop records, incident reports, arrest documentation, and other case-related information ("User Content").
Ownership: You retain ownership of all User Content you create within the App.
Responsibility: You are solely responsible for the accuracy, legality, and appropriateness of your User Content. Ensure that your use of the note-taking features complies with your department's policies regarding documentation and record-keeping.
Data Storage: User Content is stored locally on your device. You are responsible for maintaining appropriate backups and ensuring device security.
No Discovery Guarantee: ASH Labs makes no representations regarding the discoverability or admissibility of notes created in Aegis in legal proceedings.
6. Offline Functionality
Aegis provides offline access to certain databases and features. You acknowledge that:
Offline data may not reflect the most recent updates to statutes or case law.
It is your responsibility to sync the App when connectivity is available to ensure access to current information.
ASH Labs is not liable for any consequences arising from reliance on outdated offline data.
7. Intellectual Property
All content within Aegis, including but not limited to the software, design, logos, field tool interfaces, and proprietary compilations, is owned by ASH Labs or its licensors and is protected by intellectual property laws.
You may not copy, modify, distribute, reverse engineer, or create derivative works of any part of Aegis without prior written permission.
O.C.G.A. codes and case law text are public domain; however, the selection, arrangement, and presentation within Aegis are proprietary.
8. Subscription and Premium Features
Certain features of Aegis may require a paid subscription. Subscription terms, pricing, and renewal policies are presented at the time of purchase. You may manage or cancel subscriptions through your device's app store settings.
9. Limitation of Liability
To the fullest extent permitted by law:
Aegis is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
ASH Labs shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.
ASH Labs is not responsible for any decisions made or actions taken based on information provided in Aegis, including but not limited to arrests, searches, seizures, or citations.
In no event shall ASH Labs' total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless ASH Labs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of Aegis, your User Content, or your violation of these Terms.
11. Termination
ASH Labs reserves the right to suspend or terminate your access to Aegis at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.
12. Updates and Modifications
ASH Labs may update, modify, or discontinue features of Aegis at any time. We will endeavor to provide notice of material changes, but continued use of the App following any modifications constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States of America, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Georgia.
